Constitution
|
|
Article 1 |
|
The name of the Federation shall be the Asian Dance sport Federation,
hereafter re ferred to as "ADSF" or the
"Federation". The official address of the ADSF for the time being shall be the address of the Secretary General. The official language of the ADSF shall be English. |

Article 2 |
|
The IOC Charter states that: "Olympism is a philosophy of life, exalting and combining in a balanced whole the qualities of body, will and mind. Blending sport with culture and education, Olympism seeks to create a way of life based on the joy found in effort, the educational value of good example and resp ect for universal fundamental ethical principles. The ADSF shall aim, within the spirit of the Olympic Charter and in accordance wi th the Statutes and Regulations of the International Dance sport Federation ("IDSF ")to promote, spread and encourage the development of Dance sport as part of the Olympic Movement in Asia. Order of Precedence Where any conflict arises in the interpretation or execution of this Constitution, as between this Constitution and any other rules, the following order of Precedence shall apply: First the IOC Charter, then the IDSF Statutes and Rules, and Rules, and finally this Constitution. |

In order to accomplish the above, the ADSF shall: 1. Under the supreme authority of the IOC, do all such things as are required by, or incidental to the requirements of the IDSF. 2. Seek recognition of the Olympic Council of Asia and do all matters incidental to the representation of Dance sport to the Olympic Movement, including entering into arrangements with any member of the Olympic Movement such as is conducive t o the attainment of ADSF objectives. 3. Advise and assist member associations with their work in their own countries, and specifically the ADSF shall help member associations gain official recognition of their National Olympic Committees. 4. Promote cooperation amongst its members in all matters affecting their common interest, and whenever possible provide opportunities for discussion and debate by means of meetings, conferences, reunions and social functions. 5. Endeavour to bring about uniformity in rulings and decisions affecting Dancesport, and assist in the settlement of any disputes between its members in connection with Dancesport, by just and equitable means. 6. Act as a court of appeal for disputes arising between a member and one of that member's constituent parts, but only when requested by that member association. 7. Generally to carry out activities, issue pamphlets, bulletins and other publications, and accept gifts or make donations which it may deem necessary to the operations and promotion of the objectives of the ADSF. 8. Implement IDSF Rules and policies in Asia, and under the authority of the IDSF : (a) To administer licences on behalf of IDSF for Continental and Sub-Continental Championships, and to arrange, promote register or organise as it sees fit Dances port competitions, exhibitions, trials and matches. (b) To arrange lectures, seminars and training camps to train competitors, coaches and judges in the theories and practice of Dancesport. (c) To initiate and present accreditations, awards of merit or other forms of qualification or recognition to competitors, coaches, judges and such other persons or organisations as the ADSF may see fit. |

Article 4 |
|
1. Full Members, Provisional Members and Associate Member (a) The ADSF is a non-profit and voluntary association composed of national Dance sport Associations/Federations in Asia. (b) Full membership of the ADSF shall on application, be automatically granted to all full members of IDSF in the Asian region. (c) Provisional members of IDSF may be admitted as provisional members of ADSF. (d) Other Associations/Federations in Asia which have aims and objectives to promote Dancesport may be admitted as non voting Associate Members, subject to the approval of General Assembly. (e) Any association which ceases to be a member of IDSF, shall no longer be eligib le for membership of the ADSF. However such association may reapply for membership under the appropriate category. (f) No Association shall be barred from membership in the ADSF or participation i n any Dancesport Championships on political, religious or racial grounds. (g) Applications by provisional IDSF Asian members may be approved by the Executive Committee, but are subject to ratification by the Presidium. (h) Applications for associate membership must first be considered by the Presidium, which if it thinks fit shall place the matter on the agenda for the next General Assembly meeting. Associate membership may only be approved by a two thirds majority of the Members present and voting at the General Assembly meeting. (i) All new admissions and any changes to membership must be brought to the notice of all other members. (j) Membership may be withdrawn or suspended by a majority vote of the Presidium, for and member association which has not paid arrears of fees or charges outstanding for more than two years. 2. Rights & Duties of Members (a) To uphold the Fundamental Principles set out in Article 2,and pursue the Gene ral Objectives set out in Article 3. (b) To such fees and charges as are owed by it to the ADSF. (C) To select its competitors to compete in the Asian Dancesport championships an d to participate in and support various activities organised by the ADSF. (d) To play host to Asian Dancesport Championships or various events organised by the ADSF. (e) To promote Dancesport and sports cooperation in Asia. |

Article 5 |
|
1.The powers of administration to achieve the general objectives and
specific ta sks of the ADSF will be vested in the following organs: (a) General Assembly Meeting/Extraordinary General Meeting (b) Presidium (c) Executive Committee 2.Each full member is entitled to nominate not more than 2 representatives to at tend the General Assembly Meeting. 3.Full and provisional members (but not associate members) may also send observers, provided that those observers do not impose any financial burden on the Federa tion or the host country. 4.Each full member shall have two votes at the General Assembly meeting. 5.Proxy votes are allowed at the General Assembly meeting. 6.Provisional and associate member shall have no voting power. 7.Each member association (but not provisional or associate member associations) is entitled to nominate one representative to the Presidium. 8.The member association may change its Presidium member at any time by notice i n writing to the Secretary. 9.Proxy votes are not allowed at Presidium meetings. 10.Provisional members, associate members and observers shall not be admitted to any Presidium meeting. |

Article 6 |
|
1.The ADSF is governed by the General Assembly which shall meet once
every year at the venue of the Asian Dancesport Championships or on any
other convenient occasion as deemed necessary by the Executive
Committee ("EC"). 2.The General Assembly shall always be preceded by a Presidium meeting. 3.The General Assembly carry out the following activities: (a) Adoption of audited statements of accounts and the financial estimates for the ensuing year. (b) Election of the President, Vice-President, Secretary General, Treasurer and Sports Director. (c) The Executive Vice-President shall be automatically appointed from the country next hosting the Asian Dancesport Championship. (d) Approve/ratify Rules and Regulations necessary or incidental to the achievement of the aims and objectives of the ADSF. (e) Admission of new Associate Members to the ADSF. (f) Set membership or affiliation fees, and such fees as are allowed by IDSF for t he licensing of rights to host continental, sub-continental or other international championships. (g) Other matters relative to the promotion of Dancesport in Asia. 4.The Notice of meeting of the General Assembly shall be sent at least 60 days before the date of the Meeting. Propositions to be included in the Agenda must re ach the General Secretary at least 30 days before the date of the Meeting. 5.Authorities appointing Proxies must be lodged with the Secretary at or prior t o the Presidium meeting preceding the General Assembly meeting. Proxy authorities not lodged by the end of the Presidium meeting shall be invalid. |

Article 7 |
|
1.An Extraordinary General Meeting shall be convened at the request of
any five full member associations. In such case the venue for the said
Meeting shall be decided by the Executive Committee. Notice of such
Meeting together with the Agenda shall be given at least 45 days in
advance. 2.The Executive Committee by a majority vote shall have the right to convene an Extraordinary Meeting. |

Article 8 |
|
1.The Presidium is composed of the Executive Committee plus one
representative f rom each full member of the ADSF. 2.The ADSF Presidium shall meet prior to every General Assembly meeting or at such times as a majority of members shall request. 3.The Presidium shall have all of the powers of the ADSF vested in it, except tho se powers specifically reserved in the Constitution for the General Assembly / Extraordinary General Meeting. 4.A decision of the Presidium may be made by postal ballot, except in the question of amendments to the Constitution, Rules and regulations. If a written response is not received within one month, it shall be regarded as an abstention. 5.The Presidium shall select the host country for allotment of the Asian Dancesport Championships. 6.A representative of the IDSF shall be invited and admitted to every Presidium meeting. |

Article 9 |
|
1.The ADSF shall be managed by an Executive Committee which will
be convened once at least every year. 2.The Executive Committee is composed of the President, Vice-President, Executive Vice-President, Secretary General, Sports Director and Treasurer. 3.The IDSF member from a country hosting the next Asian Dancesport Championship shall be entitled to appoint the Executive Vice-President of the ADSF, who shall hold office until the date of that Asian Dancesport Championship. 4.Executive Committee members other than the Executive Vice President shall be elected from the candidates nominated by the voting representatives at the Genera l Assembly Meeting every 2 years. The Executive Vice President shall be the highest elected official of the Member Association of the country that will host the current Asian Dancesport Championships. 5.An Executive Committee member must be a member of his respective Association/f ederation. The quorum for any Executive Committee Meeting shall be half of its members. 6.A representative of the IDSF shall be invited and admitted to every Executive Committee meeting. 7.A decision on any matter which is within the legitimate authority of the Executive Committee, may be made by telephone or by fax. If an Executive Committee member is unavailable or does not respond within a week of being sent a fax ,the Executive Committee member shall be regarded as having abstained from the vote. |

Article 10 |
|
1.Between General Assembly Meetings, the Executive Committee shall have full power over the administration of the ADSF and it shall take the necessary actions on urgent matters provided that such actions not contrary to the Constitution. 2.The Executive Committee may deal with matters not explicitly provided for in t he Constitution in the best interest of the ADSF and affiliated Associations. The decisions made in such cases shall be submitted for the approval of the next General Assembly Meeting. 3.The Executive Committee shall have the power to make and modify Rules, Regulations and By-Laws in accordance with the Constitution of ADSF. The modifications shall be presented to the next General Assembly Meeting for ratification. 4.Other important items concerning the business of this ADSF which are considered necessary by the Executive Committee. |

Article 11 |
|
1.The President shall represent the ADSF, shall supervise the affairs
involved an d shall preside over Executive Committee, Presidium and
General Assembly Meetings. 2.The Vice President shall assist the President. Should the President be bound under unavoidable circumstances, The Vice President shall perform the presidential duties by proxy at the request of the President. 3.The Executive Vice President shall: (a) Raise any issues with the Executive Committee relating to the next Asian Dancesport Championship. (b) Ensure that any ADSF requirements are implemented by the host country member and/or organiser of the next Asian Dancesport Championship. 4.The Secretary General shall: (a) Manage the business of the ADSF in accordance with the decisions of the General Assembly, the Presidium and the Executive Committee as appropriate. (b) Prepare drafts of strategies and plans for presentation to the Executive Committee. (c) Be the custodian of the properties (other than funds) and records of the ADSF. (d) Appoint or discharge subordinate officers and employees of the Secretariat as directed by the Executive Committee. (e) Maintain communication with the IDSF, with all of the officers of the ADSF and with the member associations. 5.The Sports Director shall: (a)Ensure the implementation of IDSF competition rules and procedures by the ADS F. (b) Prepare drafts of ADSF Competition rules and procedures for presentation to the Executive Committee. 6.The Treasurer shall: (a) Be responsible for the safekeeping of the funds of the ADSF and make disbursements from those funds as directed by the Executive Committee. (b) Keep the books of the ADSF up-to-date, and present the audited accounts to the Executive Committee for review prior to presentation to the General Assembly Meeting. (c) Make a report to the President of the ADSF regarding all outstanding dues as may be required. (d) Collect the annual subscription from affiliated Associations/Federations as w ell as the contributions and other income arising to the ADSF. 7. The Executive Committee shall set up such Standing Committees as it deems necessary. |

Article 12 |
|
The property and assets of the ADSF shall be as follows: 1. Membership fees. 2. Sponsorship. 3. Donations. 4. Advertising and TV Rights assigned to the ADSF by the IDSF; but specifically excluding any advertising, sponsorship and TV rights together with any marketing or licensing arrangements claimed by the IDSF. The property and assets of the ADSF shall be administered by the Treasurer: the c ash thereof shall be taken into the custody of the Treasurer, through either bank deposits or other securities as deemed necessary by the Executive Committee. Any plans and budget shall be drawn by the Secretary and Treasurer. These shall b e presented to the Executive Committee for decision and thereafter to the President every year before the new fiscal year starts. |

Article 13 |
|
1.The fiscal year of the ADSF shall be from 1st April to 31st March of
the following year. 2.All membership fees must be paid within the first 2 months of the fiscal year. Other dues must be paid within 2 months of being levied. The Executive Committee may make special arrangements for any member which it considers is temporarily experiencing extreme financial difficulty. 3.Members failing to pay membership fees or other dues shall forfeit the right t o vote at any meeting of the ADSF. Voting rights may be restored when all amounts due are paid. 4.The annual financial statement of the ADSF shall be prepared by the Treasurer which together with project report, shall need the consent from the Executive Committee. 5.It shall then be reported to the President within three months after the end o f every fiscal year and must then be presented for approval by the General Assembly meeting. |

Article 14 |
|
Any amendment to this Constitution requires a two third majority vote of
those p resent and voting at a General Assembly/Extraordinary General
Meeting where 21 days notice has been given of the proposed
amendment. The ADSF will be dissolved only on a two third majority vote of those present an d voting at a General Assembly/Extraordinary General Meeting where 90 days notice has been given of the motion to dissolve the Federation. In the event of the ADSF being dissolved ,the assets of the Federation shall be assigned to the IDSF. |

hereby establish the Asian Dancesport Federation and adopt this
Constitution, as discussed and amended at the Asian Pacific Dancesport
Federation meeting held in Seoul o n 2 November 1996. 1.It is acknowledged that control of all international championships,
including Asian Continental and sub-Continental championships, rests with IDSF. 2.The Asian Dancesport Federation ("ADSF") shall act as the voice of Asia in advising IDSF how these Asian Continental and sub-Continental championships should be allocated. 3.If there is a dispute amongst ADSF members over the conduct of any of these championships, which cannot be resolved at ADSF level, then IDSF shall make the final decision. 4.five championships shall be available annually: (a) Asian Dancesport Championships (b) South East Asian Dancesport Championships (c) South Central Asian Dancesport Championships (d) West Asian Dancesport Championships (e) East Asian Dancesport Championships 5.Other regular (e.g. annual, biennial or triennial) Asian championships, cups or events shall be recommended to the IDSF by the ADSF as and when the ADSF felt it appropriate and in the best interests of the development of Asian Dancesport to d o so. 6.It is acknowledged that IDSF shall always retain control of adjudicating panel s and international TV rights for Continental and sub-Continental championships. 7.It is further understood that the ADSF shall not interfere with the right of any IDSF member to apply direct to IDSF for the right to conduct World Championships, World Cups and international events other than the Continental and sub-Continental championships mentioned above. 8.IDSF members in Asia are urged to try wherever possible to ensure the regular and if possible annual conduct of the newly established Asian Continental and sub-Continental championships. 9.The following procedure shall be used to deal with applications for Asian Continental and sub-Continental championships: (a) Preference will first be given to a member who has not recently run the particular Asian championship or sub-Continental championship. (b) Preference will secondly be given to applications to conduct combined Standard, Latin, and 10 Dance championships, but the host country can apply for one style or include all three. (c) Other things being equal, preference will be given to an IDSF member over a private promoter for the award of conduct of these championship. (d) If there are no IDSF members interested in running a particular championship or group of championships, then a reputable promoter in the chosen country could be offered the rights to conduct the event. The promoter must be financially sound, must agree to follow IDSF competition TV and advertising rules and any other conditions laid down by the ADSF. 10.The choice of member-run or promoter-run championship events shall allow young member countries the option of being the host country while avoiding large organisational and financial burdens. Note that in either case, IDSF always must select/approve the panel of adjudicators and IDSF controls the TV rights to such championships. 11.No member will be forced to conduct an event. If there are no applications for a particular Continental or sub-Continental championship in a given year, then t hat particular championship will not be held in that year. |
